Water damage in the house or flat is annoying and usually leads to a lot of paperwork, phone calls and, last but not least, moving out into temporary accommodation or a partial evacuation so that the drying and renovation work can be carried out.

Then the furniture, if it can still be saved, must be stored temporarily. Whether it's a complete move or a partial eviction with temporary storage, both options are nerve-wracking and involve considerable costs.

It needs to be clarified:
What/who caused the water damage and who can usually be held liable?

  • Was it caused by force majeure (storm etc.)?
  • Due to negligence on the part of the landlord/owner?
  • Due to the misbehaviour of another tenant?
  • Due to your own misbehaviour?

Depending on which variant applies, various insurance policies (provided they were taken out in good time) will cover the event.

In the case of force majeure (e.g. storm), it is usually the building insurance. In the case of misbehaviour by another tenant, it would be the household contents insurance.

Whatever the case, you should always take action immediately.

What to do in the event of water damage?

If you discover the water damage first, inform the landlord/property management immediately.

Tell them exactly what you know so that the cause can be quickly identified.

Any liable insurance companies must be informed in order to clarify the assumption of costs.

Assess whether it is possible to continue living in the flat/house or whether a temporary flat/hotel/boarding house needs to be rented.

If necessary, inform various providers (Internet, telephone, electricity) and the employment office/job centre that a temporary move out is necessary.

The residents' registration office must also be informed

If only part of the flat or house is affected, it is usually possible to remain in the flat/house. However, as there is rarely enough space available in your own premises, the ‘surplus’ furniture must be stored outside. You can hire a removal company for this.

As soon as all contractual formalities have been completed and the costs have been confirmed by the insurance company/property management, the stored goods will be collected on the agreed date. On request, furniture can also be dismantled and boxes packed.

You must clarify in advance with the relevant insurance company/administration how extensive the work may actually be.

As soon as the drying and renovation work has been completed, please let us know. The removal and delivery can then be planned. The invoice will be issued directly to the responsible organisation.

The move to temporary accommodation is necessary

If it is not possible to remain in the apartment/house during renovation work or for health reasons. A temporary flat, hotel or guesthouse must be found quickly.

The extent to which the relevant temporary accommodation options appear sensible depends on the duration of the work and to what extent which party bears/will bear the costs.

In the case of short but extensive renovation work, temporary accommodation is probably less sensible than renting a hotel room/guest house and temporarily storing the contents of the flat, as described above.

However, if the work has to be planned over a longer period of time, it will be necessary to move to an alternative flat. Whether you have to look for a flat yourself or one is provided for you depends on the relevant party and the legal situation.

In any case, however, it is clear that the contents of the flat (if they can still be saved) must be moved. Here too, please clarify with the relevant organisation that has to bear the costs to what extent the costs will be accepted. As soon as you have this information, look for an appropriate removal company. You are also welcome to contact us in this regard.

The removal company and the relevant organisation will settle the bill directly. You may be required to submit a declaration of assignment.

What is a declaration of assignment?

Some institutions bill the customer directly.

This means that the customer has the job carried out by the relevant removal company, pays the invoice amount himself and then recovers the money from the insurance company/building management.

To simplify the whole process, there is a declaration of assignment. This states in writing that the customer assigns the billing process to the removal company. This means that the customer does not have to pay in advance, but does not receive the invoice amount on his account, but this money must be paid directly to the removal company and the account that can be found on the invoice.
